After nearly three years of work, a Justice Department special prosecutor announced this week that he will not seek criminal charges against Central Intelligence Agency officials for destroying dozens of videotapes depicting the harsh interrrogation of two suspected terrorists.
The decision by John H. Durham, a career prosecutor with an impressive record in organized-crime and corruption cases, was condemned by civil liberties and human rights groups that argue that there was plenty of information suggesting that officials destroyed the evidence to impede an investigation into unlawful interrogations. Mr. Durham appears to have aggressively probed the issue, calling some witnesses repeatedly before a grand jury, before concluding that he did not have sufficient evidence to lodge criminal charges.
